The law in question imposed an obligation on large social media companies to issue public reports outlining their content moderation practices. It also required them to provide data on the number of objectionable posts and the measures taken to address them. However, Musk launched a lawsuit last year to prevent the law from taking effect, arguing that it infringed upon the speech protections under the U.S. Constitution's First Amendment.

In X's lawsuit, U.S. District Judge William Shubb in Sacramento refused to block the California law in December, stating it was not unjustified or unduly burdensome within the context of First Amendment law."

However, the appeals court disagreed with the lower court's decision. It held that the law's requirements were more extensive than necessary to justify the state's goal of forcing social media companies to be transparent about their moderation policies and practices. The panel instructed the lower court to review whether the content moderation part of the law could be separated from other provisions.
